By accessing and using the Face-Attendance System ("the Service") provided by Sequentec Solutions Private Limited ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions.
The Face-Attendance System is a biometric attendance tracking solution that uses facial recognition technology to record and manage employee attendance data.
We grant you a non-exclusive, non-transferable license to use the Service for internal business purposes.
All fees are payable in advance and are non-refundable unless explicitly stated otherwise.
We collect and process facial images, biometric templates, attendance records, and organizational information strictly as required to provide the Face-Attendance System and related services.
Customer data, including facial images and biometric information, is used solely for attendance tracking, verification, audit, and related operational purposes. We do not sell, rent, or use such data for advertising, profiling, analytics, or any independent purpose.
Data is stored securely on our servers or on Customer-managed local devices, depending on the selected deployment model. Personal and biometric data is retained only for as long as necessary to fulfill the stated purpose or as instructed by the Customer, after which it is securely deleted or anonymized, unless a longer retention period is required by applicable law.
We implement reasonable technical and organizational safeguards to protect personal and biometric data. In the event of a personal data breach affecting Customer data, we will notify the Customer without undue delay and provide reasonable assistance as required by applicable law.
For the purposes of applicable data protection laws, including the GDPR and the Digital Personal Data Protection Act, 2023 (India), the Customer acts as the data controller or data fiduciary, and the Company acts solely as a data processor processing personal data on the Customer’s behalf.
All intellectual property rights in the Service remain the property of Sequentec Solutions Private Limited. Customers retain ownership of their data.
Upon termination, access to the Service will cease, and data may be deleted after 30 days unless otherwise instructed by the Customer or required by law.
The Service is provided "as is". Facial recognition accuracy may vary based on lighting, device quality, and environmental conditions.
To the maximum extent permitted by law, Sequentec Solutions Private Limited shall not be liable for indirect or consequential damages.
These Terms are governed by the laws of India. Courts in New Delhi shall have exclusive jurisdiction.
The Customer confirms that it has provided all required notices to, and obtained all necessary lawful authorizations and consents from, its personnel for the collection, processing, and review of facial images solely for attendance and verification purposes. The Service Provider processes such data only on the Customer’s instructions, does not use it for any independent purpose, and applies reasonable technical and organizational safeguards to protect such data.
We may update these Terms from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
